This order will dispose of the above mentioned two petitions filed under Section 438 Cr.P.C. for the grant of anticipatory bail in case FIR No.67 dated 2.7.2017 registered for the offences under Sections 148, 149, 307, 323, 325, 506 IPC and Section 25 of the Arms Act at Police Station Industrial Sector 7, IMT Manesar, Gurugram, District Gurugram.

Cr. Misc. Nos.M-37752 of 2017 etc.

Notice of motion has been issued in these cases. Mr. B.S. Virk, learned Deputy Advocate General, Haryana has put in appearance on behalf of the respondent-State and contested these petitions.

I have heard learned counsel for the petitioners and learned State counsel and have gone through the record. Both the petitioners are stated to be armed with `Dandas'. Simple injury is attributed to Vinod Kumar-petitioner with `Danda' to Hem Raj on the head whereas the injury attributed to Rahul Chauhan is with `Danda' which falls under Section 325 IPC. The peitioners have already joined the investigation. They are not required for custodial interrogation. Keeping in view the fact that they are not the main accused and they were stated to be only armed with `Danda' each, no useful purpose will be served by sending the petitioners to custody.

In the facts and circumstances of the present cases, without discussing the facts in minute detail and without expressing any opinion on the merits of the cases, I accept these criminal miscellaneous petitions and in the event of arrest, the petitioners shall be admitted to bail on their furnishing personal bonds and surety each to the satisfaction of the Arresting/Investigating Officer. The petitioners shall join the investigation as and when called upon to do so and shall abide by the conditions of Section 438 (2) Cr.P.C.
