**** RITU BAHRI, J. (Oral) Prayer in this petition is for grant of regular bail to the petitioner, in a case arising out of FIR No.85 dated 15.06.2016, registered at Women Police Station, District Palwal, who has been booked for having committed an offence punishable under Section 366-A IPC. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case in order to put pressure on him as no medical examination of the victim has been conducted during trial. Further, there was distinction in the statements made by the victim under Section 161 Cr.P.C. and Section 164 Cr.P.C. that she was taken to Punjab and other places by the petitioner. Moreover, nothing is to be recovered from the petitioner.

CRM-M-38652-2016 -2Learned State counsel, on instructions from investigation officer, has informed that out of total 14 witnesses, only 3 has been examined so far.
I have heard the learned counsel for the parties and with their able assistance gone through the material available on record. The petitioner was arrested on 25.06.2016. Since then, he is in judicial custody and no useful purpose would be served to further detain him in jail. The final conclusion of trial will take a long time. In view of above facts, the present petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing adequate bail bonds and surety bonds to the satisfaction of learned trial Judge/Duty Magistrate, Palwal.
Needless to mention that, nothing observed here-in-above, would reflect, on merits in the trial of the main case, in any manner.
