Counsel for the complainant contends that highhandedness shown by the petitioners in grabbing the possession is contrary to the provisions of law.

State counsel, on the instructions of Inspector Boota Singh, informs that the petitioners have joined investigation. On asking of the Court, it has been informed that the petitioners are not involved in any other case of similar nature except FIR under Section 174-A IPC, arising of the present case only.

CRM-M-37750-2015 (O&M) to be a case of custodial interrogation.

The petition is allowed. It is ordered that in case of arrest of the petitioners, they will be released on bail to the satisfaction of the arresting officer subject to the conditions that the petitioners will join investigation as and when required and will not indulge in similar activity during the entire period of trial. The petitioners will also not commit any offence of the nature in which they are involved in the present case. The petitioners will not make any attempt to threaten the witnesses.

In case of violation of any of the conditions, it will be open to the complainant to approach this Court for cancellation of the bail.
