There is no denying the fact by the petitioner as stated in the written statement that he was appointed by the Principal as a Groundsman and was working in the College, thus, has to be promoted in terms of a test to be conducted by the Higher Education Department. Therefore, the one which he had taken was meant for the secondary education and accordingly cancelled as regards him.

Learned State counsel, on instructions, states that as and when a test is conducted by the education department, the petitioner may appear and would be considered for promotion as per rules, which satisfies his learned counsel.

Disposed of accordingly.
