(ORAL) The present petition has been filed by the petitioner under Section 439 Cr.P.C for grant of bail pending trial in case FIR No.02 dated 05.01.2022 registered under Sections 379-B, 201, 120-B and 216 of the Indian Penal Code, 1860, and Sections 25 and 54 of the Arms Act, at Police Station Sadar Patti, District Tarn Taran.
It is submitted by the learned counsel for the petitioner that the case against the petitioner is totally concocted. Petitioner's name was involved in the present case on the alleged statement made by him when he was arrested in another case. The police has never recovered anything regarding the crime involved in the present case. The petitioner is in custody since 18.02.2022. The petitioner is not required for any further investigation purposes. On the other hand, learned counsel for the State, being instructed by ASI Dalbir Singh, has submitted that the petitioner is a habitual of committing this kind of crime. The petitioner is involved in three more cases of similar nature, besides for some other offences. However, it is not disputed that the petitioner is in custody since 18.02.2022 and that nothing is recovered by the police from the petitioner qua the crime alleged against him.
In view the above, but without expressing any further opinion on the merits of the case, the present petition is allowed. The petitioner is ordered to be released on bail pending trial subject to his furnishing bail bonds/surety to the satisfaction of the Trial Court/Duty Magistrate, concerned.
