Naresh Kumar Sanghi, J.(Oral) Prayer in this petition is for grant of regular bail to the petitioner, Bhupinder Singh, who has been booked for having committed the offences punishable under Sections 120-B, 406, 420, 465, 467, 468 and 471, IPC, in a case arising out of FIR No.14, dated 14.01.2013, registered at Police Station, Navi Baradari, Jalandhar.

Learned counsel contends that in spite of the fact that the petitioner was arrested on 13.10.2013 and thereafter, the charges were framed on 31.01.2014, the prosecution has not been able to examine more than three witnesses. Criminal Misc.No.M-37880 of 2014 [2] Class and the petitioner has already suffered incarceration for one year and approximately three months.

Learned counsel for the State has not controverted the above submissions on factual aspects. He however submits that the petitioner is involved in yet another case of similar nature. I have heard the learned counsel for the parties and with their able assistance gone through the material available on record.

In a magisterial trial, the petitioner has already suffered incarceration for one year and approximately three months. The prosecution has still to examine 11 witnesses. Keeping in view the totality of the facts and circumstances of the case, the present petition is allowed. Petitioner, Bhupinder Singh, son of Mohinder Singh, r/o Dheer Colony, Bulandpur, Tehsil and District Jalandhar, is ordered to be released on bail during pendency of the trial of the present case subject to his furnishing bail bonds to the satisfaction of learned trial court.
