The petitioner, who is an accused in the FIR captioned above, states that he is aggrieved by frequent transfer of investigation from one police station to another, whereas the dispute is civil in nature, rather it is a monetary transaction and even the petitioner and the complainant are related to each other. He submits that at least the petitioner be heard before transfer of investigation from one police station to another. 2.

Upon this, counsel for the complainant also submits that he be also heard at that time.

Given above, the present petition is disposed of, with a direction to respondent no.2 that any officer under his/her supervision, while exercising his/her power to transfer the investigation from the present police station/investigator to any other police station/investigator, shall grant one opportunity to the petitioner as well as the complainant through their counsel, of being heard. 4.

It is clarified that there shall be no requirement to call the accused or the complainant, if they are duly represented by their respective counsel. CRM-M-18076-2025 -2that in case the competent officer calls the counsel for the petitioner or the complaint for hearing in this regard, the concerned officer shall deal with utmost decency and behaviour and if his/her behaviour is found to be derogatory, this Court shall take cognizance thereof in accordance with law.
