This is a petition filed under Section 438 Cr.P.C. seeking pre-arrest bail in a complaint case no. 2/938 dated 08.02.2013 titled as Sunil Kumar vs. Prince registered against the petitioner under section 138 of the Negotiable Instruments Act. Learned counsel for the petitioner submits that petitioner could not appear before the trial court on one date i.e 04.05.2015 as he fell ill. Due to this reason, his bail bonds and surety bonds were cancelled. Resultantly, non-bailable warrants of arrest were issued. According to learned counsel, petitioner had been regularly appearing before the trial court and never intended to absent from the court proceedings. He submits that petitioner is ready to surrender before trial court and also furnish an undertaking that he shall not absent himself from court proceedings on any date in future.
In view of above, petition is disposed of and it is directed that in case petitioner surrenders before the trial court within a week from today and applies for regular bail, his plea shall be decided on the same day.
