Naseeb Kaur And ANR v. State Of Punjab And ORS
-1IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH Date of Decision: 12.08.2021 Naseeb Kaur and another -Petitioners
Versus
State of Punjab and others -Respondents CORAM: HON'BLE MR. JUSTICE RAJ MOHAN SINGH
Present:
Mr. P.K.S. Phoolka, Advocate, for the petitioners.
**** RAJ MOHAN SINGH, J. (Oral) The case has been taken up for hearing through video-conferencing.
Petitioners seek issuance of necessary directions to the official respondents to protect their lives and personal liberties from being invaded at the hands of private respondents No.5 to 10.
On 28.06.2021 and 15.07.2021, learned State counsel informed the Court that the parties were in the process of compromising the issue. As per the police inquiry, the petitioners are living with the family members of their deceased son Jaswinder Singh.
Allegations made by the petitioners against the
-2private respondents have been found to be false. Respondent No.5 i.e. the son of the petitioners has been paying the maintenance amount to the petitioners regularly. Due to affiliation with the family of deceased son Jaswinder Singh, present petition came to be filed. Inquiry has also been consigned by the police. Inquiry conducted from the persons residing in the locality also suggested that there is no threat to the lives and personal liberties of the petitioners. Learned counsel for the petitioners submits that they are having constant threat perception for which a representation was moved to the police authority (name/designation of police authority has not come forth in Annexure P-2). I have seen the vernacular of Annexure P-2 and the same is also found to be discrepant in this regard. Notice of motion.
On the asking of the Court, Mr. Amar Ashok Pathak, Addl. A.G., Punjab accepts notice on behalf of respondents No.1 to 4.
In view of nature of order which this Court proposes to pass, there is no necessity of calling upon any response from the respondents, as no order prejudicial to the interest of any party is being passed.
-3At this stage, without embarking upon merits of the case, this petition is disposed of. If the petitioners have any threat qua their lives and liberties in future, they may approach to respondent No.3 by filing a representation and in any such eventuality, the respondent No.3 shall deal the issue in accordance with law without being influenced by the present order.
