The petitioner has filed this second petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.480 dated 8.9.2015 registered for the offences under Sections 323, 452, 307 read with Section 34 IPC and Section 25 of the Arms Act at Police Station Punhana, District Mewat.

Notice of motion to Advocate General, Haryana. Mr. B.S. Virk, learned Deputy Advocate General, Haryana has put in appearance on behalf of the respondent-State and contested this petition.

I have heard learned counsel for the petitioner and learned Deputy Advocate General, Haryana and have gone through the record. Harpal Singh Parmar 2017.02.14 16:33 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-3789 of 2017 [2] The earlier bail petition has been dismissed by this Court on 15.11.2016 and in that case the trial Court was also directed to expedite the trial.

Keeping in view the facts and circumstances of the present case, nature and gravity of the offences and the fact that the present petitioner was armed with a country made pistol, he fired from the same and the bullet crossed the armpit of the complainant- Jamshed etc., I do not find it a fit case where the present petitioner is entitled to the benefit of regular bail.

Therefore, finding no merit in this petition, the same is dismissed.

The copies of zimini orders of the trial Court have been placed on record which show that the trial Court is adjourning the case and discharging the present witnesses. The trial Court is directed to strictly comply with the directions given by this Court and also to send the report to this Court to strictly comply with the order passed by this Court. The learned Sessions Judge, Nuh, is further directed to monitor the progress of the case regularly.
