Petitioner prays for bail pending trial in FIR No.83 dated 19.07.2014, under Sections 419/420/465/467/468/471/120B IPC, registered at police station Phase 11, Mohali, Punjab.
As per prosecution version, co-accused Mohinder Singh opened a fictitious bank account in the complainant - Bank impersonating Nawab Singh and deposited a sum of `20,00,000/- in the said account. Mohinder Singh while impersonating Nawab Singh issued cheques of `10,00,000/- and `9,00,000/- in favour of petitioner - Gurdeep Singh projecting him as Rajveer Singh. The said sum was withdrawn from the account.
It is submitted that main accused in this case is Mohinder Singh, who has been granted bail pending trial on 20.10.2014 and co-accused Amandeep OMKAR SINGH 2015.02.13 12:00 I attest to the accuracy and authenticity of this document Chandigarh
CRM No.M-37932 of 2014 [2] Singh @ Aman was granted bail pending trial on 29.09.2014. Challan/report under Section 173 Cr.P.C. has been presented. The petitioner is in custody since 28.07.2014.
Learned counsel for the State, on instructions from ASI Balraj Singh, confirms that the other co-accused, namely, Mohinder Singh and Amandeep Singh @ Aman have been granted the concession of bail pending trial and report under Section 173 Cr.P.C. has been presented. Charge is yet to be framed. There are no allegations on behalf of the State that petitioner is likely to abscond or that he is likely to dissuade the witnesses from deposing true facts in the Court, if released on bail.
Trial is likely to take a long time to conclude. As per information supplied, petitioner is not involved in any other case. Keeping in view the facts and circumstances of the case but without commenting or expressing any opinion on the merits thereon, it is considered just and expedient to allow this petition.
Consequently, this petition filed by Gurdeep Singh is allowed. Petitioner shall be released on bail pending trial subject to his furnishing requisite bail bonds and surety bonds to the satisfaction of the Trial Court/Duty Magistrate, SAS Nagar, Mohali.
None of the observations made hereinabove shall not be construed to be a reflection on merits of the case and shall have no bearing on trial. ( LISA GILL ) February 12, 2015.
