Noticing the prayers made in the applications, date of hearing of the main case is preponed from 15.10.2025 to today and it is ordered to be taken up on Board.

By making a reference to the settlement/compromise dated 29.05.2025, Annexure A-1, entered into between the parties, it has been jointly submitted by counsel for the parties that the dispute has been amicably settled. Attention of this Court has been invited to paras 9 and 10 of the settlement, wherein it has been mutually agreed that judgment and decree dated 21.02.2025 passed by the learned Additional District & Sessions Judge, Yamuna Nagar be set KAMAL SHARMA 2025.07.08 17:29 I attest to the accuracy and authenticity of this order/judgment.

RSA-1111-2025 (O&M) -2aside and the instant appeal shall be disposed of in terms of the compromise. It has been further submitted that the Court Fee affixed by both the parties be ordered to be refunded.

In view of the above, impugned judgment and decree dated 21.02.2025 passed by the learned Additional District & Sessions Judge, Yamuna Nagar is set aside and the instant appeal is disposed of in terms of compromise dated 29.05.2025, Annexure A-1, which is ordered to be made a part of the decree. Court Fee affixed by the appellant before this Court and by respondents before the Trial Court is ordered to be refunded to them in view of Section 16 of the Court Fees Act, 1870 read with Section 89 of the CPC, 1908. 4.
