In the present petition, the grievance being raised by the petitioner is that the petitioner has competed for the post of Group C & D as advertised vide advertisement No. 1/2023 dated 30.05.2023 (Annexure P-1) and though in the written test for the post in question, the petitioner has secured more marks than the last selected candidates in BC- A category under sub-category of eligible Sports person (ESP) but the petitioner has not been selected and appointed on the post in question, for which, she was fully eligible.

Learned counsel for the petitioner submits that once, the candidate having lower merit has already been selected for the post in question, the merit of the petitioner which is higher than the last selected candidate, could not have been ignored by the respondents. 3.

Learned counsel for the petitioner submits that the petitioner has already raised the said grievance in the representation dated 08.03.2024 (Annexure P-7) but the same is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a direction is issued to the respondents to decide the same by passing an appropriate speaking order in a time bound manner. On the asking of the Court, Mr. Harish Nain, AAG, Haryana, who is present in Court, accepts notice on behalf of the respondent-State and submits that in case, the representation dated 08.03.2024 (Annexure P-7) has been received in the office of the concerned authorities and the same is still pending consideration with the authorities concerned, the same will be decided by the competent authority within a period of eight weeks from the receipt of certified copy of this order by passing an appropriate speaking order.

Learned counsel for the petitioner submits that keeping in view the statement of learned State counsel, the present petition may kindly be disposed of having been not pressed any further. 7.
