(ORAL) Learned counsel for the petitioner submits that it is a fit case where the petitioner ought to be released on regular bail in view of the fact that he has already been in incarceration since 04.08.2019. There are no criminal antecedents of the petitioner and he has been falsely implicated in the FIR in question on an alleged recovery of 100 injections of Buprenorphine. 2.

Be that as it may, she submits that she is confining her prayer, at this stage, to seek interim bail due to the imminent requirement of presence of the petitioner in the family to attend bhog ceremony of his mother, who died on 13.06.2021. Petitioner being younger son is required to be present at the Bhog Ceremony along with other family members. 3.

She contends that as regards factum of death of the mother, the same has been verified by the Municipal Councilor of the Area, per Annexure P/4 (an application submitted to Jail Superintendent). She submits that Bhog ceremony has been put on hold and the date would be fixed depending upon the petitioner being released on interim bail or not. In the premise, the Jail Superintendent is directed to get the fact of the death of petitioner's mother verified. In case, it is found to be so, the petitioner shall be admitted to bail subject to furnishing of his bail bonds/surety bonds to the satisfaction of the Duty Magistrate/Chief Judicial Magistrate and would be released for a period of four weeks from the date the bail bonds are accepted by the Court below and he shall surrender himself on expiry of four weeks thereafter.
