ARVIND SINGH SANGWAN, J. (Oral) The petitioner prays for grant of anticipatory bail in FIR No.74 dated 20.04.2017 registered under Sections 419, 420, 465, 467, 468, 471 and 120-B IPC at Police Station City Phagwara, District Kapurthala.
The operative part of the order dated 28.05.2019, vide which interim anticipatory bail has been granted to the petitioner, is reproduced as under:- "....Counsel for the petitioner relies upon the order dated 09.05.2019 passed by this Court in CRM-M No.6725 of 2019 granting anticipatory bail to co-accused Kunish Kumar and submits that the co-accused Hemraj has already deposited the amount of Rs.1,51,140/-...." Counsel for the petitioner has submitted that, in pursuance to the order dated 28.05.2019, the petitioner has appeared before the Investigating Officer and has joined the investigation. CRM-M No.24607 of 2019 submitted that two of the co-accused of the petitioner namely Kunish Kumar and Hemraj, who has deposited the amount of Rs.1,51,140/-, have already been granted the concession of anticipatory bail. Counsel for the State, on instructions from HC Inderjeet Singh, has not disputed the aforesaid fact and submits that the petitioner is no more required for further investigation. It is also submitted that challan is likely to be submitted before the trial Court on completion of the investigation.
In view of the above, this petition is allowed and the interim bail granted to the petitioner vide order dated 28.05.2019 is made absolute subject to the conditions envisaged under Section 438(2) Cr.P.C.
