*** RAJESH BHARDWAJ, J. (ORAL) Present writ petition has been filed for quashing the impugned notice dated 09.04.2024 (Annexure P-1) passed by respondent No.2 on the instance of respondent No.4 which is illegal, arbitrary and against the law and Punjab Municipal Corporation Act, 1976. Further prayer has made for directing the respondents not to harass on the name of unauthorized construction at the instance of respondent No.4 who is moving false applications online as well as offline and for directing respondent No.1 to initiate appropriate action under Section 182 Cr.P.C. for moving false application and propaganda against the family members of the petitioner.

Learned counsel for the petitioner has reiterated his contentions as raised earlier.

CWP No.9030 of 2024 -2- 2024:PHHC:059632 This Court vide order dated 23.04.2024 had directed respondent No.2 to be present in person in Court and Mr. Ashok Pathria, Executive Officer, Municipal Council, Zirakpur is present in person in Court today.

On interaction with the Court, it has apprised that there are violations made by both the petitioner and respondent No.4 and thus both of them have been served with the notice. It is submitted that the petitioner has already filed the reply but she wants to file the additional reply.

The Officer present has submitted before this Court that if the petitioner files the additional reply in response to the same, she would be given an opportunity of personal hearing and further action would be taken in accordance with law.

In view of the above position, the present petition is disposed of with liberty to the petitioner to file her additional reply in response to the impugned notice dated 09.04.2024 and submit the same within a period of two days from today and thereafter, she would appear before respondent No.2 on 06.05.2024 at 11.00 A.M. However on hearing the same, respondent No.2 i.e. Executive Officer, Municipal Council, Zirakpur, SAS Nagar, Mohali would pass the necessary order in accordance with law.
