The petitioner has filed this second petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.41 dated 6.3.2018 registered for the offence under Section 379-B IPC at Police Station Sarabha Nagar, Ludhiana, District Ludhiana.

Notice of motion to Advocate General, Punjab. Ms. Monika Jalota, learned Deputy Advocate General, Punjab has put in appearance on behalf of the respondent-State and contested this petition.

I have heard learned counsel for the petitioner and learned Deputy Advocate General, Punjab appearing for the respondent-State and have gone through the record.

Cr. Misc. No.M-38876 of 2018 [2] As per the allegations in the FIR, which was got recorded by Harpreet Kaur Sandhu, one young boy came on a motorcycle and caught hold of the purse of the complainant, due to which she fell down along with her child and her purse came out of her shoulder and she received injuries on her left arm. Thereafter, the motorcyclist snatched the purse of the complainant and fled away from the spot.

As per the prosecution version, one mobile relating to the complainant has been recovered from the present petitioner. Challan has already been presented but the statement of the complainant has not been recorded so far. In case the bail is granted to the petitioner, there is every chance of tampering with the evidence. Therefore, no ground is made out for the grant of regular bail to the petitioner at this stage. Therefore, finding no merit in this petition, the same is dismissed.
