Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.86 dated 30.04.2009 under Sections 323, 324, 506 and 34 IPC registered at Police Station Adampur, District Jalandhar.

Learned counsel for the petitioner admitted that earlier the petitioner was on bail and he absented from the proceedings on 27.07.2011 and could not join the proceedings. He further contended that petitioner was told that he was acquitted from the proceedings by his Advocate and therefore, he could not join the proceedings. I have heard learned counsel for the petitioner and have gone through the record.

The perusal of the record shows that the petitioner was regularly appearing in the Court and when no order of acquittal has VINEET GULATI 2015.02.11 12:27 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-3790 of 2015 -2been passed in his presence, then how he can absent from the proceedings continuously for years together. The petitioner has already been declared proclaimed offender. Furthermore, the petitioner has already misused the concession of bail. In view of the above, I do not find it a fit case where the petitioner is entitled to benefit of grant of anticipatory bail. Therefore, finding no merit in the present petition, the same is dismissed.
