The petition has been filed, inter alia, seeking a writ of mandamus directing respondent no.2/Commission to consider the petitioner's candidature for the post of Trained Graduate Teacher-English, and allow her to participate in the interview scheduled on 24.4.2019, as she has cleared HTET exam as per the requirement. 2.

It is apparent on record that the Commission had taken a decision to call all those candidates for scrutiny of documents vide notice dated 27.4.2019, who were earlier ineligible due to not having HTET certificate or were absent from scrutiny of documents for any other reason. Accordingly, the petitioner was also short-listed for scrutiny of documents and was found eligible. She has been interviewed provisionally pursuant to interim order, dated 24.4.2019, passed by this Court.

CWP No.10612 of 2019 -2- 2023:PHHC:150041 which showed that she has secured 100 marks in the SC category, to which she belongs, and the marks of last selected candidate in the category are 104, and 99 of the last wait-listed candidate. 4.

Since the petitioner has been considered eligible and she has secured 100 marks (90 in written test and 10 in viva voce), which are above the cut-off marks of last wait-listed candidate in the category, the writ petition is disposed of with direction to the respondents to place the petitioner as per her merit in the waiting list, and consider her for appointment against the advertised posts, in accordance with law.
