Petitioner seeks the concession of pre-arrest bail in a case registered on the basis of secret information alleging that two dumphers along with huge quantity of liquor were being carried from Ambala to Rajasthan.

Counsel for the petitioner submits that the petitioner is not even named in the secret information and that he was not arrested from the spot.

State counsel informs that name of the petitioner was disclosed by Kulwant Singh whose name was disclosed by Om Parkash arrested from the spot.

Taking into consideration the circumstance that no

CRM-M-37938-2015 (O&M) recovery was effected from the petitioner, the identity of the petitioner as well as his involvement will be a debatable issue during the course of trial.

The petitioner has joined investigation pursuant to the interim order passed by this Court on 5.11.2015. The petition is allowed. It is ordered that in case of arrest of the petitioner, he shall be released on bail to the satisfaction of the Investigating Officer subject to the conditions that he will join the investigation as and when required by the police and will not indulge in similar activity of which he is accused of in the present case.

In case of violation of any of the conditions, it will be open to the Investigating Agency to seek cancellation of the bail. (M.M.S. BEDI) January 19, 2016.
