(ORAL) Learned State counsel contends that the instant petition has rendered infructuous in view of the fact that final report under Section 173(2) Cr.P.C. has already been filed in the court. The petitioner has already been charge-sheeted. Therefore, no investigation is pending with the Punjab Police, which can be transferred to CBI. In view of the above, instant petition is dismissed as having been rendered infructuous.
