HARINDER SINGH SIDHU, J Prayer is for grant of regular bail in case FIR No.99 dated 25.02.2021 under Sections 193,201,205,297,406,420,467,468,471,120-B IPC registered at P.S Narnaund, Police District Hansi, District Hisar. FIR was got lodged by Dr. Brajesh Kumar Rajput, Investigation Manager, Risk and Loss Mitigation Unit, HDFC Ergo General Insurance Company with the allegations that a Syndicate targeted the persons belonging to poor socio-economic conditions who were suffering from terminal illness like cancer etc and a number of accidental death policies were purchased in their names. Fake claims under the personal accident policy were got filed by the nominees of the insured.

It is also alleged that possibility of hospital staff being hand in gloves with the fraudsters could not be ruled out as false post-mortem were prepared by the doctors. A number of private hospitals are alleged to be involved in this practice. It is stated that one of such policies was purchased in the name of Sunil Kumar on 06.04.2018 for a sum of Rs. 15,00,000/-. The insured died on 12.04.2018. Father of his deceased son Sunil Kumar filed false claim MANOJ KUMAR 2021.08.

CRM-M-23603 of 2021 #2# alleging that his son had died due to accidental injuries whereas the death had taken place due to TB ailment.

Learned counsel for the petitioner contends that the petitioner has falsely been roped in this case. He submits that the petitioner is not agent of any Insurance Company. He is a practising Advocate and the only allegation against him is that he facilitated some of fake insurance policies on the basis of which false insurance claims have been made. He has been in custody since 19.03.2021. The investigation is complete and challan qua him has been filed.

Opposing the petition, learned State counsel submits that six other cases of similar nature have been registered against the petitioner. The role of the petitioner as facilitator in getting fake accident insurance policy is very serious.

Without commenting anything on the merits of the case and also bearing in mind the fact that the trial is not likely to conclude in near future, in my opinion, no useful purpose will be served by detaining the petitioner behind bars any further. The petition, as such, is accepted. The petitioner Sunil Kumar is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
