The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.23 dated 15.10.2015 registered for the offence under Section 354 IPC at Police Station Women Cell, Nuh. Notice of motion has been issued in this case. Mr. Himmat Singh, learned Assistant Advocate General, Haryana has put in appearance on behalf of the respondent-State and contested this petition. Police record is also available. I have heard learned counsel for the petitioner and learned Assistant Advocate General, Haryana appearing for the respondent-State and have gone through the record.

Cr. Misc. No.M-37962 of 2015 [2] Dahiya, Fishery Officer, Mewat against the present petitioner by alleging that she called Jaan Mohd. in her office for inquiry in connection with the inquiry marked to her by the Deputy Commissioner and Additional Deputy Commissioner, Nuh. Since the inquiry against Lukman was already going on, Lukman Khan came to her office and started threatening her by saying that she (Fishery Officer) is demanding money from the farmers and he had recording of same and he himself gave his mobile to her. On her saying that she would show this recording tomorrow in the office of Deputy Commissioner, then Lukman started manhandling with her and torn her clothes. I have also seen the police record where statement of other witness has been recorded regarding the alleged outraging the modesty of the complainant.

Keeping in view the facts and circumstances of the present case and the allegations against the petitioner in the FIR, I do not find it a fit case where the petitioner is entitled to the benefit of anticipatory bail. Therefore, finding no merit in this petition, the same is dismissed.
