SUMEET GOEL, J.(Oral) Present third petition has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS')/Section 439 read with Section 482 of Cr.P.C. for grant of interim regular bail to the petitioner in case FIR No.249 dated 08.11.2023 registered for the offences punishable under Sections 302, 307, 326, 328, 201, 467, 468, 471, 120-B of the IPC [erstwhile Sections 103(1), 109, 123, 238, 338, 336(3), 340(2), 61(2) of BNS] and Section 72(A) of the Punjab Excise Act, 1914 (Haryana Amendment Bill, 2020) and Section 42(a) of Prisons Act, 1894, at Police Station Farakpur, District Yamuna Nagar on medical grounds.

On being called upon, learned State counsel has filed the reply by way of affidavit of Kanwaljeet Singh, HPS, Deputy Superintendent of Police, Head Quarter, Yamuna Nagar in Court today. The same is taken on record. Relevant paragraphs No.5 and 6 thereof read thus: "5. That as per the information collected by the investigating agency, all the vitals of the petitioner are stable. The petitioner is suffering from paralysis bilateral lower limb with bowel and bladder involvement with chronic bed sore over left gluteal region. The patient has been bed ridden with catheter in situ since 2017.

That as per the information collected by the police from the Jail Authorities, Karnal, the patient is conscious oriented and afebrile at the time of medical examination and the petitioner can do his routine activities with the help of helper and treatment mentioned in medical status report (Annexure R-1) is being provided to the petitioner in the District Jail, Karnal."

Having heard learned counsel for the rival parties and upon perusal of the record, especially keeping in view the medical condition of the petitioner as reflected in the above reply filed by the State, the present petition is allowed and the petitioner is afforded interim regular bail for a period of two months from the date of his being released on his furnishing bail/surety bonds to the satisfaction of the Ld. concerned CJM/Duty Magistrate. However, in addition to conditions that may be imposed by the concerned CJM/Duty Magistrate, the petitioner shall remain bound by the following conditions:
(i) The petitioner shall not mis-use the liberty granted.
-3- (ii) The petitioner shall not tamper with any evidence, oral or documentary, during the trial.
(iii) The petitioner shall not absent himself on any date before the trial.
(iv) The petitioner shall not commit any offence while on bail.
(v) The petitioner shall deposit his passport, if any, with the trial Court.
(vi) The petitioner shall give his cell-phone number to the Investigating Officer/SHO of concerned Police Station and shall not change his cell-phone number without prior permission of the trial Court/Illaqa Magistrate. (vii) The petitioner shall not in any manner try to delay the trial.

In case of breach of any of the aforesaid conditions and those which may be imposed by concerned CJM/Duty Magistrate as directed hereinabove or upon showing any other sufficient cause, the State/complainant shall be at liberty to move cancellation of interim bail of the petitioner.

Ordered accordingly.

Nothing said hereinabove shall be construed as an expression of opinion on the merits of the case.
