(Oral) This is a petition for anticipatory bail filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, (BNSS), 2023 in FIR No.76 dated 11.03.2025 under Sections 22, 27(a) of NDPS Act (Section 29 of NDPS Act added later on) registered at Police Station Civil Lines Batala, District Gurdaspur.

Learned counsel for the petitioner contends that the petitioner was neither named in the FIR nor apprehended at the spot. He has been arraigned as an accused on the basis of disclosure statement of co-accused Baljit Singh. It is alleged in the FIR that on 11.03.2025, co-accused Baljit Singh and Prem Pal were found in possession of 60 and 70 intoxicant tablets separately and consequent to their arrest, 400 more intoxicant tablets were recovered from each of the co-accused. They had further disclosed the name of the accused stating that he used to run a medical store and supply such intoxicant tablets to them. However, it is further stated that the petitioner is running a cosmetic shop and is not involved in any other case under the NDPS Act. CRM-M-18090-2025 -23. This Court, vide order dated 02.04.2025, had directed the petitioner to appear before the Investigating Officer and join investigation and in the event of his arrest, he was ordered to be released on ad-interim bail to the satisfaction of the Investigating/Arresting Officer, subject to the conditions envisaged under Section 438(2) Cr.P.C.

Learned State counsel on instructions submits that the petitioner has joined the investigation and is not required for custodial interrogation. 5.

In view of the submissions of learned counsel for the petitioner especially when the petitioner having joined investigation, the order dated 02.04.2025 granting interim bail to the petitioner is made absolute. 6.

However, the petitioner shall abide by the conditions stipulated under Section 438(2) Cr.P.C. He shall also join investigation as and when called upon to do so.

The petition stands allowed.
