**** JAISHREE THAKUR, J. (ORAL) By this common order, this Court proposes to dispose of above referred two petitions as both have arisen out of the same FIR. Both these petitions under Section 438 Cr.P.C. that have been filed by the petitioner(s) seeking grant of anticipatory bail to them in case FIR No. 9 dated 05.02.2015, under Sections 406, 498-A, 380 IPC, registered at Police Station Women Cell, Jalandhar. In brief, the facts are that the complainant got married with petitioner Manjit Singh on 20.02.2012 and it was the love marriage between them. However, certain disputes arose between the parties leading to the

-2registration of the aforesaid FIR. Manjit Singh and his father mentioned in the FIR, approached before this Court for grant of anticipatory bail in the instant petitions.

To see whether the parties can resolve the dispute amicably, the matter was referred to the Mediation and Conciliation Centre of this Court, which resulted in a settlement agreement arrived at between Joginder Singh i.e. father-in-law of the complainant and the complainant herself on 03.02.2017. In terms of the agreement arrived at, Wellma and Manjit Singh along with their two minor children will join each others company. Apart from other terms and conditions of the settlement, it has been agreed between the parties that all cases shall stand withdrawn. This Court takes notice of the fact that the agreement has been arrived at between Joginder Singh i.e. father-in-law of the complainant and the husband i.e. Manjit Singh is not a party to the said settlement.

At this stage, learned counsel for the petitioner Manjit Singh, husband of the complainant tendered an affidavit of Manjit Singh to the effect that he will remain bound by all the terms and conditions of the compromise/agreement dated 03.02.2017 and will not violate any of the terms of the same. The affidavit is taken on the record. All the parties are present in the Court today. Heard.

Since the matter stands resolved amicably, the petitions are allowed and interim order dated 17.11.2015 is hereby made absolute subject to the condition that the petitioners will not tamper with evidence or hamper the investigation; will not leave India without permission of the Court and will comply with the conditions contained in Section 438(2) Cr.P.C.
