**** RAJ MOHAN SINGH, J.(Oral) Vide this common order, CWP Nos.13273, 14051, 14056, 13289 of 2021 are being decided.
Petitioners have preferred these writ petitions for the
issuance of an appropriate writ, order or direction especially in the nature of mandamus directing the respondents to release their payments for the works done along with interest. It is not in dispute that different works assignments were allotted to the petitioner(s)/firm. Petitioners have successfully completed the work assignments to the entire satisfaction of the Department/respondents. The defect liability period has already lapsed, but the bills/claim of the petitioners have not been answered, despite representations/letters sent by the petitioners.
It appears that the works were completed by the petitioners in the year 2017 and even the entitlements were acknowledged by the Department in the year 2019 with assurance to pay the dues within a specified period, but till date the amount has not been paid.
Learned State counsel on instructions from Mr. Parvesh Kumar, Asstt. from Water and Sanitation Department submits that the entitlements of the petitioners for different work assignments have been verified and the department is in the process of paying the dues to the petitioner within a period of two weeks.
In view of above, all the writ petitions are disposed of with a direction that needful be done by the respondentdepartment within a period of two weeks. The amount in
question be paid within the specified time along with interest @ 6% per annum from the date of accrual of cause of action till final realization of the same.
