(ORAL) The petitioner herein seeks the relief of regular bail in the criminal case pertaining to the FIR bearing No.244 dated 27.04.2014 registered at Police Station City Jagadhri, District Yamuna Nagar, under Sections 392, 473, 365 IPC.

Status-report filed on behalf of the respondent-State, by way of the affidavit of Deputy Superintendent of Police, Jagadhri (Yamuna Nagar), is already available on the file and the same is taken on the record.

I have heard learned counsel for the petitioner as well as learned State counsel in this petition and have also perused the file thoroughly.

Learned counsel for the petitioner argues that the petitioner is in custody since 25.10.2019 and the trial of the case will take long time to conclude and it being so, the petitioner deserves the relief as prayed for in this petition.

Per contra, learned State counsel argues that the petitioner is a habitual offender and hence, this petition deserves dismissal/rejection. However, keeping in view the facts that the petitioner is behind the bars since 25.10.2019 and the trial of the case is likely to take sufficient time to conclude and without commenting or expressing any opinion on the merits of the case, the petitioner named Rahul @ Lucky is ordered to be released on regular bail subject to his furnishing the requisite bail bonds and surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
