The present writ petition has been filed under Article 226/227 of the Constitution of India with a prayer for issuance of an appropriate writ or order in the nature of mandamus directing the respondent No.2 to decide the statutory appeal dated 10.03.2026 (Annexure P-15) filed by the petitioner against the punishment order dated 13.02.2026 (Annexure P-14) passed by respondent No.1. Further prayer has been made to respondent No.1 not to bring into effect the punishment order dated 13.02.2026 (Annexure P-14) till decision of the statutory appeal dated 10.03.2026 (Annexure P-15) by respondent No.2.

Learned counsel for the petitioner submits that at this stage, she will be satisfied if a direction is issued to respondent No.2/competent authority to decide the statutory appeal dated 10.03.2026 (Annexure P-15) of the petitioner by passing a speaking order in a time bound manner. She further prays that till final disposal of the aforesaid statutory appeal, recovery from the salary of petitioner may be stayed. 3.

Mr. Fateh Singh Sidhu, Advocate appearing for Mr. T.S. Sidhu, Advocate accepts notice and also filed memo of appearance on behalf of the respondents, which is ordered to be taken on record. Registry is directed to place the same at an appropriate place. He submits that he had no objection in case a direction is issued to respondent No.2/competent authority to hear and decide the statutory appeal of the petitioner dated 10.03.2026 (Annexure P-15) in a time bound manner.

Therefore, in view of the limited prayer made by learned counsel for the petitioner, without commenting upon merits of the case, present petition is disposed of and respondent No.2/competent authority is directed to hear and decide the statutory appeal dated 10.03.2026 (Annexure P-15) in a time bound manner and pass a speaking order, within a period of 03 months from the date of receiving a certified copy of this order.

Since the statutory appeal is still pending and yet to be decide, it would be in the interest of justice that no further recovery will be effected from the petitioner till the disposal of the appeal. 7.

Pending miscellaneous application(s), if any, also stands disposed of.
