1. The present petition has been filed for directing the respondents to consider the candidature of petitioners under Ex-Serviceman (Self) in their respective categories for recruitment to the posts of ETT Cadre. 2. Learned counsel submits that the petitioners had applied for the posts of ETT Teachers under Ex-Serviceman Category (Self), however, due to technical error, their category has been shown to be Ex-Serviceman (Dependent). It was once corrected qua petitioner Nos.2, 4 and 7, vide Annexure P-7, thereafter, also the category is being shown to be (Dependent) vide Annexure P-12. Though, even during the scrutiny, the documents substantiating the petitioners to be ExServiceman (Self), have been duly submitted. He further submits that similar issue has arisen before Hon'ble the Supreme Court in Vashist Narayan Kumar vs.

The State of Bihar and Others in Civil Appeal No.1 of 2024 and decided in favour of the petitioners holding that the trivial errors can be rectified. In this regard, a collective representation dated 08.04.2024, Annexure P-11, has been submitted by them, which has yet not evoked any response. He thus, at this stage, on instructions, submits that the petitioners are sanguine of it being considered in a MOHIT 2024.04.

In view of the above and without commenting on the merits of the case, this petition is hereby disposed of with a direction to the respondents to consider and decide the collective representation dated 08.04.2024, in light of the afore-referred judgment, within a period of 6 weeks, which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner. Upon doing so, after notice and hearing offered to them and if found entitled, grant the benefit forthwith. Needless to say, if the orders are adverse to their interest, the same shall contain reasons and the petitioners shall be free to seek legal redress thereupon
