(Oral) Present petition is for release of petitioner on regular bail in FIR No.351 dated 09.12.2015, under Sections 363, 366-A, 376(2)(n) and 120-B IPC and Sections 5/4/6/16 of Protection of Children from Sexual Offences Act, 2012, registered at Police Station City Sangrur, District Sangrur.

Learned counsel for the petitioner submits that a perusal of order dated 05.12.2016 passed in CRM-M-42571-2016 whereby regular bail has been granted to the co-accused of the petitioner, namely, Ramvir Singh, shows that Ramvir Singh is the grandson of paternal aunt of the complainant.

CRM-M-381-2017 -2Learned State counsel, on instructions from the investigating officer, has informed that as per the school leaving certificate the age of the prosecutrix Meena is 25.05.1999 and she had attained majority on 25.05.2017.

Meena, the prosecutrix in the present case, is present in Court and states that she does not want to accompany the present petitioner (Mukesh Kumar), who is also present in the Court. Keeping in view the above and the fact that Ramvir Singh (coaccused of the petitioner) is stated to be grandson of the aunt of the complainant, the interim bail granted to the present petitioner, vide order dated 23.01.2017, by this Court, is hereby made absolute. Needless to mention that, nothing observed here-in-above, would reflect, on merits in the trial of the main case, in any manner.
