This petition has been filed for issuance of directions to respondents No.1 to 4 to register FIR against private respondents No.5 to 7 and to protect the life and liberty of the petitioner from them. 2.
Notice of motion was issued in this case on 08.07.2021. Learned State counsel refers to status report dated 13.09.2021 filed by way of affidavit of Daljeet Singh, Dy. Superintendent of Police (City), Fatehabad, in particular to para 3 and 4 thereof, which read thus:- "3. That brief facts of the case are that on 10.05.2021, an information was received in Police Post Gurunankpura Fatehabad regarding some quarrel between the petitioner and private respondents upon which ASI Ravinder Singh, Incharge Police Post Gurunankpura reached at the spot and it was found that no such occurrence took place at the spot as alleged by the present petitioner and no injury was caused by anyone to the present petitioner and only mutual dispute was found. It is worthwhile to mention here that there is some dispute regarding the land between both the parties and both the parties claim their possession on the land in dispute. ASI Ravinder Singh directed both the parties to maintain peace and not to quarrel with each other and if there is any issue, they can move complaint for the same.
4. That on 10.05.2021, a complaint was filed by present petitioner which was received in Police Post ASHOK KUMAR 2023.08.28 19:08 I attest to the accuracy and integrity of this document

During the process of enquiry, both the parties came present in the Police Post Gurunankpura and made request twice that both the parties wants to settle their dispute in a brotherhood Panchayat and seek time for the same which was signed by present petitioner and father of respondent No. 5. True translated copy of the writing is annexed herewith as Annexure R-1 for kind perusal of this Hon'ble Court."

Further reference is made to Annexure R1, it being a joint statement by petitioner and father of respondent No.5 against whom the allegations were made, which reads thus:- "That in connection with land dispute between Joginder Singh Virk and Gajan Singh son of Kundan Singh resident of Khan Mohammad, Fatehabad, both the parties will settle their dispute in a brotherhood Panchayat and seek time upto 31.05.2021 for the same and till then, we will not fight."

In view of the above, no further orders are required to be passed and the present petition is disposed of as having been rendered infructuous with liberty to the petitioner to avail of alternate remedy, if any, available to him in accordance with law.
