**** ANITA CHAUDHRY, J(ORAL) This is the second petition filed by the petitioner seeking regular bail in FIR No. 474 dated 9.10.2015 registered at Police Station Sadar Panipat, district Panipat under Sections 304-B, 34 IPC. Counsel for the petitioner at the outset states that an application under Section 319 Cr.P.C. was moved which has been dismissed and all the private witnesses have been examined and Dharampal had turned hostile in the cross-examination and the brothers of the victim have also not supported the prosecution version. He refers to the statements made available on the record. Counsel further contends that the petitioner is in custody since 9.10.2015.

The petitioner is in custody for over a year. The private witnesses have been examined. The complainant has not supported the prosecution version.
