Learned counsel for the petitioners submits that while declaring the result for Group- C and Group-D posts as advertised vide Advertisement No. 1/2023 dated 30.05.2023 (Annexure P-1), certain candidates have been given the marks under the Socio Economic Criteria but certain candidates have been denied the same and in the case of the petitioners, though they had claimed the benefit of marks under the Socio Economic Criteria but the said benefit has not been extended to them, which act on the part of the respondents is totally arbitrary and illegal. 2.

Learned counsel for the petitioners further submits that in case, 5 marks under the Socio Economic Criteria are extended to the petitioners, the petitioners will secure more marks than the last selected candidate in the category in which the petitioners are competing hence, the respondents are under an obligation to revise the merit list qua the petitioners by granting them 5 marks under the Socio Economic Criteria. 3.

Learned counsel for the respondents submits that in case the petitioners have any grievance for non-grant of the marks under the Socio Economic Criteria despite being entitled and any such claim is raised before the authorities concerned by way of representation, the said claim will be considered and appropriate order on the said claim will be passed within a period of four weeks of the receipt of any such claim. 6.

Learned counsel for the petitioners submits that keeping in view the statement of learned counsel for the respondents, the present writ petition may kindly be disposed of having been not pressed any further with liberty to the petitioners to file appropriate representation. 7.
