 !"#  $ Allegations against the petitioner Taranjit Singh in this anticipatory bail application filed under Section 438 Cr.P.C. in case FIR No.141 dated 30.12.2014 registered at Police Station Ramdass, District Amritsar under Section 420 IPC, are that in the month of December, 2012 petitioner along with his co7accused/non7applicant have approached the complainant to send his son Navtej Singh to Malaysia and in pursuance of the same had received a sum of 2,02,000.  State counsel that the son of the complainant remained in Malaysia for a period of 1 year and 1 month and that he was supposed to provide him with a work permit, which compelled him to return back. Vide order dated 06.02.2015 while issuing notice of motion, the petitioner was granted interim bail to the satisfaction of the Investigating Officer.  The contentions of learned counsel for the petitioner that there was no such contract and the allegations are mere oral one and after staying for 1 year and 1 month in Malaysia and on returning back to India after a delay of one year has made present complaint, could not be controverted by learned State counsel. Keeping in view this inordinate delay and that the element of civil dispute is there over the allegation of work permit, compels this Court to grant bail to the petitioner.

In the light of these discussions, the interim bail granted to the petitioner vide order dated 06.02.2015 is made absolute on the same terms and conditions till submission of report under Section 173 Cr.P.C. (challan). Thereafter, petitioner will be permitted to furnish regular bail bonds to the satisfaction of the trial Court. The petition stands disposed off accordingly. #  !$   %&'("
