**** ANITA CHAUDHRY, J(ORAL) The petitioner is seeking regular bail in FIR No. 141 dated 8.6.2013, registered at Police Station City Barnala, District Barnala under Sections 376, 120-B, 382, 341, 342, 506, 148, 149 IPC. Counsel for the petitioner contends that the petitioner is in custody since 29.10.2014 and only three witnesses have been examined out of 21. Counsel urges that the complainant is a divorcee and the prosecutrix and the alleged eye witnesses have been examined. State counsel states that there are several other cases against the petitioner. A list of the same has been placed on record. According to the list, 10 cases have been registered against the petitioner. The trial in 05 cases has concluded and the petitioner has been acquitted. The other cases are under Sections 382, 356, 323, 452, 394 IPC. Even after one year and 10 months, the prosecution has been able to examine only three witnesses. The trial will take time. Crl. Misc. No. M-3899 of 2016 -2Without commenting anything on the merits of the case and considering the fact that the trial will take time to conclude, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing local surety and adequate bonds to the satisfaction of the trial Court/Duty Magistrate. Petitioner would stay away from the victim and the eye witnesses.
