Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner(s) in case FIR No. 136 dated 31.10.2013, registered under Section(s) 15 & 25 of the Narcotic Drugs & Psychotropic Substances Act, 1985 at Police Station Sangat, District Bathinda. Learned counsel for the petitioner contended that petitioner was earlier admitted to bail in this case and had been regularly attending the Court. However, on 19.9.2017, he could not appear before the learned Court below as the Clerk of his counsel gave him incorrect date and on inquiry, he came to know that his bail bonds and surety bonds were cancelled. Learned counsel further contended that petitioner is ready to surrender before the learned Court below.

In view of above, the present petition is disposed of with the direction that petitioner shall surrender before the learned Court below and move a fresh application for grant of bail and the learned trial Court shall Deepak Kumar Bhardwaj 2017.10.12 15:29 I attest to the accuracy and integrity of this document

Criminal Misc. No. M- 38152 of 2017 consider the same and decide it expeditiously. However, the learned trial Court shall also be at liberty to complete the proceedings under Section 446 Cr.P.C.
