ASHOK KUMAR VERMA, J. (ORAL) The petitioner has filed the second petition under Section 439 Cr.P.C., for grant of regular bail in case FIR No. 291 dated 06.08.2021 registered under Sections 20(B)(ii)(C) of NDPS Act, Police Station City Sohna, District Gurugram.
According to the prosecution story, on 06.08.2021, the petitioner along with his co-accused-Juber was apprehended by the police for carrying 30 Kgs. of Ganja with them. Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case. Challan has already been presented before the trial Court and out of total 14 prosecution witnesses only 02 have been examined, so far. CRM-M-22393-2022 -22023:PHHC:040547 is not involved in any other case under the NDPS Act. Petitioner is in custody since 06.08.2021. The trial is likely to take long time. No useful purpose will be served by further detention of the petitioner in custody. Thus, it is prayed that the petitioner may be released on regular bail. On the other hand learned State counsel has opposed the present petition.
Keeping in view the facts and circumstances of the case, period of custody of the petitioner and also the fact that conclusion of trial would take sufficient long time, but without commenting anything on merits of the case, the present petition is allowed. The petitioner-Anil , is ordered to be released on regular bail subject to his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate/Chief Judicial Magistrate concerned.
