The counsel for the petitioner made statement that he withdraws the present petition, however, liberty be given to him to approach the Sessions Court.

In the light of the aforesaid statement made by counsel for the petitioner, the present petition is dismissed as withdrawn with liberty aforesaid.

Accordingly, the petition stands disposed of without commenting on the merits of the case.
