The instant petition has been filed by the petitioner seeking a writ of mandamus for directing the respondents to decide the statutory appeal dated 03.03.2022 (Annexure P-1) filed by petitioner before the Board of Directors of respondent - Bank, impugning the order of dismissal dated 16.02.2022.

The petitioner has earlier filed a petition i.e. CWP No.24312 of 2021, seeking retiral benefits, however, the said writ petition was withdrawn by the petitioner vide order dated 19.07.2022, to pursue his statutory appeal and raise all available pleas including that of his entitlement to the retiral benefits along with interest, etc. before the said authority. Yet another writ petition being CWP No.23412 of 2023, was filed by the petitioner impugning the order of dismissal dated 16.02.2022 (Annexure P-1) and further for issuance of appropriate directions to respondents to pay the retrial dues and the said writ MOHD YAKUB 2024.04.26 18:32 I attest to the accuracy and authenticity of this document Punjab & Haryana High Court at Chandigarh

CWP No.9514 of 2024 (O&M) 2024:PHHC:057050 petition was disposed of by this Court vide order dated 16.10.2023. The concluding para of the said order, reads as under:- "In view of the position stated above and the fact that against the order of dismissal, the petitioner has already preferred statutory appeal and although the same has been heard, but no orders stated to have been passed/conveyed to the petitioner. As such, at this stage, the present writ petition is not maintainable, being premature. However, petitioner is always at liberty to challenge the order so passed against him, in the statutory appeal filed by him against his dismissal, is so advised.

Hence the present writ petition is dismissed." 3.

Learned counsel for the petitioner submits that the statutory appeal has been heard by Board of Directors, however, no final decision has been conveyed to the petitioner.

Without going into the merits of the case at this stage, it would be appropriate to direct respondent No.2 to take a final decision on the appeal dated 03.03.2022 (Annexure P-1), filed by the petitioner against the order of dismissal within a period of 03 months from the date of receipt of certified copy of this order. 5.

The petition stands disposed of.
