(Oral) The applicant-wife has filed the present application for seeking transfer of the petition under Section 9 of the Hindu Marriage Act i.e. DMC/41/2025, titled 'Baljeet Singh Vs. Rajni Kaur', filed by the respondent-husband, pending in the Family Court, Bathinda and she seeks transfer of the same to the Court of competent jurisdiction at Ferozepur. Upon notice, the respondent did not make appearance and as such, was proceeded against ex parte vide order dated 23.12.2025. Counsel for the applicant heard.

It is submitted by the counsel for the applicant that the marriage between the parties had taken place on 27.05.2024, but no child was born from the said wedlock. On account of matrimonial dispute, the parties are residing separate. The applicant is not having any source of earning and is dependent upon her parental family. The applicant has also got lodged an FIR bearing No.7 dated 13.02.2025 at Women Police Station, Ferozepur, against the respondent, which is pending investigation. Besides the same, she has also filed petition under Section 144 of BNSS, which is pending in the Courts at Ferozepur and respondent is making appearance in the same. The distance between the two places is stated to be about 100 kilometres.

In view of the submissions aforesaid, considering the fact that the applicant is having no source of earning and the fact of two other litigation, already pending in the Courts at Ferozepur, which are being pursued by the respondent and also, taking into consideration the distance between the two places and above it, the respondent not having come forward to resist the transfer application, the same is allowed and the petition under Section 9 of the Hindu Marriage Act i.e. DMC/41/2025, titled 'Baljeet Singh Vs. Rajni Kaur', filed by the respondent-husband, stands transferred from the Family Court, Bathinda, to the Court of competent jurisdiction at Ferozepur. The requisite record of the aforesaid case be sent by the Family Court, Bathinda, to the District and Sessions Judge, Ferozepur.

Learned District and Sessions Judge, Ferozepur, shall assign the said petition to the Family Court, Ferozepur.
