The petitioner whose services had earlier been terminated was later reinstated upon an appeal having been filed before Statutory Appellate Authority, but arrears of her salary for the period her services remained terminated were not given. The petitioner was constrained to file CWP19659-2018 which was accepted and a direction was issued vide order dated 5.2.2020 to the effect that the arrears of salary for the said period be released within 3 months.

The needful not having been done, the petitioner has approached this Court seeking initiation of proceedings under Contempt of Courts Act. However I find that before approaching this Court, the petitioner had not issued any notice to the respondent concerned.

Faced with the aforesaid position, the learned counsel for the petitioner submits that he may be permitted to withdraw this petition at this stage with liberty to approach this Court again in case needful is not done and that he shall file requisite representation to the respondent concerned. 5.

In view of the aforesaid submission, the petition is dismissed as withdrawn with liberty aforesaid. In case any representation is moved by the petitioner in compliance of order dated 5.2.2020, the respondent shall dispose of the same expeditiously preferably within a period of 2 weeks from filing of such representation.
