******* SURINDER GUPTA, J.(Oral) Above captioned petitions have been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to petitioners in case FIR No. 92 dated 15.06.2016 registered for the offences punishable under Sections 420, 465, 468, 471 read with Section 120-B of Indian Penal Code (for short 'IPC'), at Police Station City-I, Malerkotla, District Sangrur. Heard.
It is submitted that co-accused Abdul Latif, who as per allegations in FIR, is main accused has already been allowed pre-arrest bail vide order dated 26.10.2016 passed in CRM-M-37034 of 2016. CRM-M-39111 of 2016 -2pending between them. Present dispute also pertains to property allegedly owned by the complainant.
Keeping in view the fact that main accused Abdul Latif has already been allowed anticipatory bail but without expressing any opinion on the merits of the case, both these petitions are allowed and order dated 31.10.2016 and 07.11.2016 passed in respective petitions are made absolute till the presentation of challan, subject to the following terms:- (i) that petitioners shall make themselves available for interrogation by the police as and when required; (ii) that petitioners shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the accusation against them so as to dissuade him from disclosing such facts to the Court or to any police officer;
(iii) that petitioners shall not leave India without the prior permission of the Court.
(iv) that petitioners will seek regular bail on the presentation of challan in Court.
