RAJESH BHARDWAJ, J.(ORAL) Instant petition has been filed under Section 482 Cr.P.C. praying for quashing of FIR No.15, dated 06.02.2019, under Section 376 IPC and Section 6 of POCSO Act, registered at Police Station Kalka, District Panchkula, and all the proceedings consequent thereto on the basis of compromise.
It has been contended by learned counsel for the petitioner that petitioner and the prosecutrix both are married and they have a child also. On the other hand, learned State counsel submits that all the witnesses stand examined before the trial Court and the case is fixed for 16.08.2022 for recording the statement under Section 313 Cr.P.C. In view of the above-mentioned facts and circumstances of the case, the present petition is disposed of with liberty to the petitioner to pursue his remedies before the trial Court.
