(ORAL) The only argument raised by the learned counsel for the petitioner is that the sentence awarded be ordered to be reduced as the accident took place on 19.5.2000 and the petitioner has already suffered protracted trial and criminal prosecution for 19 years. The petitioner has been convicted and sentenced to a period of two years for the offence under Section 304-A of the Indian Penal Code, with fine of Rs.2500/-.

CRR-1419-2009 (O&M) to the accident Gurdeep Singh, a child of 5 years, had died. Custody certificate has been produced according to which the petitioner has already undergone imprisonment for 22 days. Keeping in view the facts and circumstances of the present case and also while noting that the petitioner is a first time offender, the sentenced awarded to the petitioner, is reduced to six months. The petition is disposed of.
