IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH CRM-M-38271 of 2017 Date of Decision: 21.11.2017 Randhir Singh @ Rinku ....Petitioner

Versus

State of Punjab ....Respondent CORAM: HON'BLE MR. JUSTICE RAMENDRA JAIN Present: - Mr. Tarun Vir Singh Lehal, Advocate, for the petitioner. Ms. Bhavna Gupta, DAG, Punjab.

RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner Randhir Singh @ Rinku in a case arising from FIR No.1 dated 14.01.2011 registered under Sections 302, 307, 148, 149 IPC and Sections 25 and 27 of the Arms Act at Police Station Rangar Nangal, District Gurdaspur.

Learned counsel for the petitioner contends that petitioner is in custody since 03.08.2017. All co-accused of the petitioner have already been acquitted. The conclusion of trial shall take a long time. No useful purpose would be served by detaining the petitioner in jail. Learned State counsel, on instructions from ASI Major Singh submits that supplementary challan has been filed against the petitioner and the case has been committed to the Court of learned Sessions Judge. Considering over-all facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on bail, on his furnishing bail bonds and surety bonds, to the satisfaction of Trial Court/Duty Magistrate concerned.
