The present petition has been filed under Articles 226/227 of the Constitution of India for issuance of an appropriate writ in the nature of mandamus directing the respondent-department to conclude the departmental proceedings against the petitioner which was initiated vide charge-sheet dated 15.04.2014, Annexure P-1.

Learned counsel for the petitioner submits that the departmental proceedings that came to be initiated by issuance of charge-sheet dated 15.04.2014, Annexure P-1, had been finalized as per the order dated 30.11.2016, Annexure P-5, on information having been sought by him under the Right to Information Act, 2005 for supplying the copy of the order that had been passed against him. He further submits that vide letter dated 29.05.2023, Annexure P-12, the petitioner has been intimated that the decision on the charge-sheet is yet to be taken and the copy of the enquiry report shall be supplied to him prior thereto. He further submits that in the wake of the above, the order of promotion which was issued in his favour on 18.03.2016, Annexure P-7, has not been given effect to. Mr. Satnampreet Singh, learned DAG, Punjab accepts notice on behalf of the respondents-State and submits that he has no objection to the limited prayer made by learned counsel for the petitioner.

In view of the aforesaid and without commenting upon the merits of the case, this petition is hereby disposed of with a direction to the respondents to finalize the proceedings pending against the petitioner in four months and in case the same culminate in his favour, take further decision in accordance with law as regards his promotion is concerned.
