(ORAL) Counsel for the petitioner submits that the petition was filed way back in the year 2016 and in the interregnum, charge sheet filed against the accused persons and case is at the stage of evidence. He further submits that the only grievance of the petitioner is that the accused were not charged for offence under Section 379 IPC, whereas there is sufficient material on record to proceed against them under Section 379 IPC also.
He further submits that he would be contended and satisfied in case, he be permitted to file an application before the trial Court for alteration of charges by placing on record material in this regard, which are also part of the present petition. The fair trial is a right of accused as well as complainant and cannot be denied to the petitioner, who is a complainant. Given above, in case the petitioner files any such application within 30 days from today before the trial Court, then the concerned Court shall pass a reasoned order on the same in accordance with law after hearing the all stake-holder keeping in view the aforesaid prayer.
The present petition stands disposed of in the aforesaid manner. All pending JYOTI 2022.12.15 14:39 I attest to the accuracy and integrity of this order/judgment.
