Prayer in the present petition under Section 528 BNSS, 2023, is for quashing of the impugned order dated 08.04.2021 (Annexure P-2), whereby petitioner has been declared proclaimed offender in FIR No.37 dated 30.04.2018, registered at Police Station Kot Ise Khan, District Moga, in view of the fact that compromise dated 18.10.2024 (Annexure P-4) effected between the complainant and petitioner's father and affidavit dated 18.10.2024 (Annexure P-5) executed by the complainant in support of the same.

In fact, during the pendency of the proceedings in the aforementioned FIR, parties settled their dispute amicably by executing compromise deed dated 18.10.2024 (Annexure P-4) accompanied with affidavit of the same date, and thereupon, filed one quashing petition i.e. CRM-M-61615-2025, based upon compromise dated 18.10.2024. In the quashing petition filed on the basis of compromise dated 18.10.2024, parties were directed by this Court to appear before the Court of learned Magistrate and thereupon, a report was called for from the court of Judicial Magistrate 1st Class, Moga. 4.

Parties appeared before the Court below, got recorded their respective statements and thereupon, on receiving of the satisfactory report from the Court of Judicial Magistrate 1st Class, Moga, proceedings in criminal case i.e. FIR No.37 dated 30.04.2018, under Sections 420, 120-B IPC, registered at Police Station Kot Ise Khan, District Moga, have already been quashed along with all consequential proceedings by a separate order of even date, in the petition titled as 'Kewal Singh Bains and anr. vs. State of Punjab and anr.'

As the proceedings have already been quashed in the main case i.e. FIR No. 37 dated 30.04.2018, along with all consequential proceedings, there is no necessity to pass a separate order in the present petition for quashing of the order by which petitioner - accused was declared proclaimed offender on account of his absence. 6.
