The matter is taken up for hearing through video conference due to COVID-19 situation.

The present petition is filed seeking regular bail in case of FIR No. 67, dated 13 th August, 2012 under Sections 307, 148 r/w 149 of the Indian Penal Code, 1860 and Sections 25, 27, 54 and 59 of the Arms Act, 1959 registered at Police Station Dugri, District Ludhiana.

The contention raised by learned counsel for the petitioner is that the Additional Sessions Judge, Ludhiana vide order dated 26 th May, 2020, rejected the bail of the petitioner as petitioner absented when earlier bail was granted. C RM-M-20005-2020  [2] in order to meet with the apprehension, the petitioner is ready to furnish heavy surety.

Learned State counsel submits that the petitioner is involved in number of cases and that he has misused the bail earlier. She, however, is not having instructions as to whether while on bail, the petitioner was involved in another crime. The order dated 26 th May, 2020 of the Additional Sessions Judge, Ludhiana is set aside and the matter is remitted back to be decided afresh, taking into consideration the relevant facts put forth by State counsel and the offer of heavy surety to be furnished by the petitioner.

The petition is disposed of.
